A TOTTINGTON woman has become the first in the borough to be prosecuted for littering by Bury Council.

Tracey Hacking, of Bury Road, admitted throwing a cigarette butt from a car window.

She was fined £75 plus costs of £100 by Bury magistrates.

The court heard that a council environmental enforcement officer spotted a woman driver at the junction of Hollins Brow and Manchester Road. As the vehicle pulled away, he saw her discard the cigarette she had been smoking.

DVLA records showed that the car was registered to Hacking, and she was sent a letter asking her to identify the driver.

Hacking said she could not remember where she was on the day in question and did not provide any details about the driver on that day. She was issued with a fixed penalty notice for £50 and then a reminder letter.

The court fined Hacking £50 for the litter offence and £25 for failing to identify herself as the driver of the vehicle responsible.

Councillor John Byrne, executive member for transport and environment, said after the case: "Litter is high on the list of things that upset people. The purpose of litter enforcement is to deter people from littering: hopefully this fine will deter those who are still throwing their rubbish about the borough."
